1. Acceptance of Terms

By accessing or using AI Writer ("the App", "the Service"), you confirm that:

1. You have read and understood these Terms of Service in their entirety.
2. You agree to comply with and be legally bound by these Terms.
3. You are at least 13 years of age (or the age of digital consent in your jurisdiction).
4. You have the legal capacity to enter into a binding agreement.

If you are using the App on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

AI Writer is a mobile application that uses artificial intelligence to:

• Generate structured professional documents from user-provided topics.
• Translate uploaded documents into 30+ languages while preserving structure.
• Summarize uploaded documents into concise key-point reports.
• Output documents in four formats: PDF, Word (DOCX), PowerPoint (PPTX), and Excel (XLSX).
• Automatically embed relevant stock images from Pexels.
• Provide a built-in editor for post-generation content customization.

The Service also includes user accounts, a token-based usage system, a referral rewards program, and an in-app notification system.

3. Account Registration & Security

3.1 Account Creation

To use AI Writer, you must create an account by providing:

• A username
• A valid email address
• A password

You agree to provide accurate, current, and complete information during registration and to keep your account information up to date.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your password and account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized access to or use of your account.

We strongly recommend enabling Two-Factor Authentication (2FA) for enhanced security. AI Writer is not liable for any loss or damage arising from your failure to maintain the security of your account.

3.3 One Account Per User

Each user may maintain only one account. Creating multiple accounts to circumvent usage limits, abuse the referral program, or for any other purpose is strictly prohibited and may result in termination of all associated accounts.

4. Token System & Usage Limits

4.1 Token Allowance

AI Writer operates on a token-based usage system. Each account receives a daily token allowance. This limit:

• Resets every 24 hours.
• Is tracked server-side and tied to your account.
• May be adjusted at our discretion with or without notice.

4.2 Free Trial Tokens

New users may be eligible for a one-time free trial token grant. This offer:

• Is limited to one claim per account.
• Cannot be transferred or combined with other offers.
• May be modified or discontinued at any time.

4.3 Daily Token Claims

Users may claim additional daily tokens subject to availability and server-defined limits. Token claims are non-transferable.

4.4 Token Abuse

Any attempt to manipulate, exploit, or artificially inflate your token balance (including but not limited to creating multiple accounts, using automation, or exploiting bugs) is a violation of these Terms and may result in immediate account termination.

5. Referral Program

5.1 How It Works

AI Writer offers a referral rewards program where you can earn bonus tokens by inviting new users:

• Each account receives a unique referral code.
• When a new user registers using your referral code, you earn bonus tokens.
• Referral rewards are tiered — the more successful referrals you make, the higher your tier and daily bonus.

5.2 Referral Rules

• Referral codes are for personal sharing only. Mass distribution through spam, bots, or paid advertising is prohibited.
• Self-referrals (referring your own alternate accounts) are prohibited.
• We reserve the right to void referral rewards obtained through fraudulent or abusive means.
• Referral rewards have no cash value and cannot be exchanged for money.
• We may modify, suspend, or terminate the referral program at any time.

6. User Responsibilities

As a user of AI Writer, you are solely responsible for:

• All content you upload to or input into the App.
• Ensuring you have the legal right to upload, process, translate, or summarize any content.
• How you use, distribute, or publish the documents generated by the App.
• Compliance with all applicable local, national, and international laws.
• Verifying the accuracy and appropriateness of AI-generated content before use.
• Maintaining the security of your account credentials.

7. Prohibited Content and Conduct

You agree NOT to use AI Writer to process, generate, upload, or distribute:

7.1 Illegal Material

• Content that violates any applicable law or regulation.
• Material related to illegal activities, fraud, or criminal conduct.
• Content that facilitates or promotes illegal actions.

7.2 Copyright Violations

• Pirated books, articles, or publications.
• Paid courses or educational content without authorization.
• Copyrighted works without proper licensing or permission.
• Content you do not own or have explicit rights to process.

7.3 Harmful Content

• Hate speech, discrimination, or content promoting violence against any group.
• Harassment, threats, or intimidation of any kind.
• Content promoting self-harm or harm to others.
• Sexually explicit or exploitative material.
• Content targeting or exploiting minors in any way.

7.4 Malicious Conduct

• Attempting to exploit, hack, or reverse-engineer the App or its server.
• Using automation, bots, or scripts to interact with the Service.
• Attempting to bypass usage limits, rate limiting, or security controls.
• Interfering with or disrupting the Service or its infrastructure.
• Spam, misleading information, or disinformation campaigns.

7.5 Confidential Material

• Classified government documents without authorization.
• Trade secrets or proprietary business information you do not have rights to process.
• Personal data of third parties without their consent.

8. In-App Notifications

AI Writer includes an in-app notification system that delivers:

• System announcements and maintenance notices.
• Token balance alerts and daily claim reminders.
• Referral program updates and reward notifications.
• Feature updates and service changes.

You can manage notification preferences in your account settings. Essential service notifications (security alerts, terms changes) may not be disabled.

9. AI-Generated Content Disclaimer

AI Writer uses artificial intelligence to generate content. You acknowledge and agree that:

• AI-generated content may contain errors, inaccuracies, or outdated information.
• AI-generated content should not be relied upon as the sole source for critical decisions.
• AI Writer does not guarantee the accuracy, completeness, reliability, or suitability of generated content.
• You are solely responsible for reviewing, verifying, and validating all AI-generated content before use.
• AI-generated content is not a substitute for professional advice (legal, medical, financial, academic, or otherwise).
• AI Writer is not liable for any consequences resulting from reliance on AI-generated content.

10. No Warranty

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

To the fullest extent permitted by applicable law, AI Writer disclaims all warranties, including but not limited to:

• Implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the Service will be uninterrupted, error-free, secure, or free of viruses.
• Warranties regarding the accuracy or reliability of AI-generated content.
• Warranties regarding the availability or performance of third-party APIs or our server infrastructure.
• Warranties regarding the continuous availability of token grants, referral rewards, or free trial offers.

11. Service Availability & Maintenance

• AI Writer may be temporarily unavailable due to maintenance, updates, or server issues.
• We reserve the right to enable maintenance mode, which may temporarily restrict access to certain features.
• We reserve the right to activate a remote kill switch to disable the App in case of critical security incidents.
• We are not liable for any loss or inconvenience caused by service interruptions.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AI WRITER AND ITS DEVELOPERS, OFFICERS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

• Any direct, indirect, incidental, special, consequential, or punitive damages.
• Loss of profits, revenue, data, goodwill, or other intangible losses.
• Damages resulting from your use of or inability to use the Service.
• Damages resulting from AI-generated content, including errors or omissions.
• Damages resulting from unauthorized access to your account or data.
• Damages resulting from third-party services, APIs, or content.
• Loss of tokens, referral rewards, or other virtual benefits.

This limitation applies regardless of the theory of liability, even if AI Writer has been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify, defend, and hold harmless AI Writer and its developers, officers, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses arising from:

• Your use of the Service.
• Content you upload, input, generate, or distribute through the Service.
• Your violation of these Terms.
• Your violation of any applicable law, regulation, or third-party right.
• Any claim that content you processed infringes the rights of a third party.
• Unauthorized use of your account due to your failure to maintain security.

14. Third-Party Services

AI Writer relies on third-party services including:

• AI API Provider — For AI-powered document generation, translation, and summarization.
• Pexels API — For sourcing stock images under the Pexels License.
• Cloudflare — For server infrastructure and website hosting.

We do not control these third-party services and are not responsible for their availability, accuracy, policies, or practices. Your use of AI Writer is also subject to the terms and policies of these providers.

15. Account Termination

We reserve the right to:

• Suspend or terminate your account at any time, for any reason, with or without notice.
• Discontinue the Service or any part of it at any time.
• Remove or refuse to process content that violates these Terms.
• Void referral rewards obtained through abuse or fraud.
• Reset token balances if abuse is detected.

You may delete your account at any time by contacting us. Upon termination:

• Your right to use the Service ceases immediately.
• Your account data will be deleted from our servers.
• Files stored locally on your device will not be affected.
• Accrued referral rewards and tokens are forfeited.

Provisions that by their nature should survive termination (including Limitation of Liability, Indemnification, and Governing Law) shall survive.

16. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first, and if necessary, through binding arbitration or the courts of competent jurisdiction.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and Copyright Policy, constitute the entire agreement between you and AI Writer regarding the use of the Service.

19. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes:

• The "Last Updated" date will be revised.
• Significant changes may be communicated through the App's notification system or this website.

Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.
